What the complaint alleges

The complaint says Elanco owns the CYDECTIN brand of moxidectin-based parasiticide and endectocide products sold in the United States since at least 2000, and that for more than twenty-five years it has used purple coloring in the liquid formulation of its CYDECTIN pour-on product. It alleges that purple dye is deliberately added, that the color is nonfunctional, and that the trade dress has acquired secondary meaning. It identifies U.S. Registration No. 7,657,229, which it says issued on January 21, 2025, from Application Serial No. 97/768,048, covering veterinary parasiticide preparations, including pour-on endectocides for cattle, in Class 5.

It alleges that Bimeda Animal Health Ltd., an Irish company, is the sponsor of Abbreviated New Animal Drug Application No. 200-845 for MoxiSolv Pour-On, approved by the FDA on August 10, 2026, and that Bimeda Inc. is the U.S. agent and manufacturer. It alleges MoxiSolv is a purple-colored topical moxidectin formulation that Bimeda markets as the first bioequivalent to Cydectin Pour-On. Count I alleges federal trademark infringement under 15 U.S.C. § 1114. Count II alleges false designation of origin and unfair competition under § 1125(a). Count III alleges federal trademark counterfeiting under §§ 1114(1)(a) and 1127. The complaint also pleads Illinois deceptive-trade-practices, common-law unfair competition and trade-dress infringement, and unjust enrichment. The prayer seeks injunctive and monetary relief. That is a prayer for relief. A court has not granted it.

A complaint is not a ruling

None of this is a finding. A newly filed complaint tells you what Elanco alleges about purple pour-on trade dress and MoxiSolv. It does not tell you that Bimeda infringed, counterfeited, or competed unfairly. The court has not decided the case.
