What was filed
Hive Market Holdings LLC v. Cinnies LLC, No. 2:26-cv-10273 (C.D. Cal.), was filed September 11, 2026 (31 pages). Hive Market Holdings says it is a Delaware limited liability company. It alleges, on information and belief, that Cinnies LLC is a California limited liability company based in Los Angeles. (Compl. caption; para. 15.)
The marks
Hive alleges it devised and began using the CINNIES mark in December 2022 for bakery goods, bakery products, and frozen dough, that it owns Registration No. 7,635,253 for CINNY ROLLS, registered December 31, 2024, for bakery goods and bakery products in Class 30, and that it has common law rights in CINNY. It alleges its CINNIES application, Serial No. 99065113, was filed on March 3, 2025 under what the complaint calls Hive's former name, and that the entity that held that name, now a Hive affiliate, assigned the CINNIES and CINNY ROLLS rights, application, and registration to Hive Market Holdings on August 27, 2026. USPTO Trademark Status and Document Retrieval records list Registration No. 7,635,253 as live, owner Hive Market Holdings LLC, and list Serial No. 99065113 as an application with an opposition pending at the Trademark Trial and Appeal Board. (Compl. paras. 2, 11 to 12, 38 to 44.)
What the complaint alleges
Hive alleges, on information and belief, that Cinnies began using CINNIES as the name of its cinnamon roll business in or around March 2025. It alleges that it wrote to Cinnies on June 9, 2025 and followed up on June 23, 2025, that Cinnies never responded or changed its use, and, on information and belief, that Cinnies has since expanded that use. It alleges Cinnies uses the name on Instagram and TikTok accounts and the cinnies.co domain. It alleges that on May 8, 2026, Cinnies filed TTAB Opposition No. 91307199 against Hive's CINNIES application, contending that CINNIES is merely descriptive and fails to function as a mark, and it says it relies on the opposition only as evidence of willfulness and of a live controversy, not as a basis for relief. (Compl. paras. 3 to 6, 51 to 86.)
The counts and relief
The six claims are federal trademark infringement under 15 U.S.C. 1125(a)(1)(A), false designation of origin and unfair competition under 15 U.S.C. 1125(a)(1)(A), infringement of a registered mark under 15 U.S.C. 1114(1), California common law trademark infringement and unfair competition, and a declaratory judgment under 28 U.S.C. 2201 and 2202 that Hive is the senior user and owner of CINNIES, CINNY ROLLS, and CINNY. The prayer seeks an injunction, changes to Cinnies' domain and social media names, destruction of materials, profits, enhanced damages, fees, and exemplary damages on the state claims, and Hive demands a jury. (Compl. paras. 104 to 150; Prayer.)
