What was filed

The complaint is Document 1 in Intelligent Change, LLC v. Guoquan Huang, No. 3:26-cv-00751 (W.D.N.C., Charlotte Division), filed September 21, 2026. It runs 18 pages and demands a jury trial. Intelligent Change is described as a Delaware limited liability company. The docket shows the case assigned to District Judge Kenneth D. Bell and Magistrate Judge David Keesler.

The marks

The complaint says Intelligent Change has sold THE FIVE MINUTE JOURNAL, a guided gratitude journal, since about 2013. It lists Registration Nos. 4,596,523, 5,350,016, and 7,076,482 for FIVE MINUTE JOURNAL marks and Registration No. 8,268,983 for THE FIVE MINUTE JOURNAL + Design, the registration asserted in its federal infringement count, and it says it has applied to register the trade dress itself. USPTO TSDR lists Reg. No. 8,268,983 for THE FIVE MINUTE JOURNAL as registered on the Principal Register on May 26, 2026, owned by Intelligent Change, LLC, in Classes 9 and 16.

What the complaint alleges

The complaint alleges, on information and belief, that Huang controls the GOSSIP FOX seller account and is responsible for making, importing, and selling a gratitude journal listed on Amazon under ASIN B0B4BC97JT. It alleges that the journal copies the overall commercial impression of THE FIVE MINUTE JOURNAL Trade Dress and is sold for the same purpose, to the same consumers, through the same online channel. It identifies Huang as the applicant behind GOSSIP FOX Registration No. 7,488,522, which USPTO TSDR lists for paper bags, owned by Huang, Guoquan. On information and belief, it alleges the copying was intentional and willful.
