What was filed
The complaint is Document 1, filed October 16, 2026, in the U.S. District Court for the Central District of California. The case is Shanghai Greatcare Trading & Developing Co. Ltd. v. Lssx Inc., No. 5:26-cv-06134. It runs 12 pages. The plaintiff is a company organized under the laws of the People's Republic of China with its principal place of business in Shanghai. The defendant, Lssx Inc., is a California corporation that the complaint says has its principal place of business in Upland, California. Greatcare demands a jury.
The marks
Greatcare asserts U.S. Registration No. 7,737,361, a sunflower design, and No. 7,737,360, a butterfly design, both for goods in International Class 21 including fly traps, insect traps, oven mitts, barbecue mitts, gardening gloves and cleaning cloths. The complaint says Greatcare filed the applications on June 18, 2024, that they registered March 25, 2025, and that Greatcare has used the marks in commerce since at least 2020. USPTO records show both registrations on the Principal Register, describing the first mark as a design resembling a sunflower formed by the outline of a sun connected at the bottom to an inverted triangle, and the second as the outline of a butterfly connected at the bottom to the outline of a downward facing arrow. Each registration lists a first use date of May 1, 2024. USPTO records name a Delaware corporation as the registrant of both; that corporation assigned both registrations, with their goodwill, to Shanghai Greatcare Trading & Developing Co., Ltd. by an assignment executed March 30, 2026 and recorded April 13, 2026 at Reel 9233, Frame 0747. Greatcare is the current owner of record.
The TTAB cancellations
On August 20, 2026, Lssx Inc. filed petitions at the Trademark Trial and Appeal Board to cancel both registrations: Cancellation No. 92092613 against No. 7,737,361 and Cancellation No. 92092607 against No. 7,737,360. On October 19, 2026, Greatcare moved in each proceeding to suspend it pending the civil action. On October 20, 2026, the Board suspended Cancellation No. 92092613 pending disposition of that motion.
What the complaint alleges
The complaint says Greatcare has made fly traps with the marks in China since as early as 2016, and that since 2020 its authorized U.S. importer has sold them on Amazon through the importer's own store. It alleges that Lssx incorporates the marks into fly traps sold on Amazon, that it named its Amazon store after the importer, and that the importer confirmed it has no connection with Lssx. It alleges that Lssx registered MOSQUEDA on the Supplemental Register on June 6, 2023, after a refusal on the Principal Register, that it submitted a picture of Greatcare's product as its evidence of use, and that it then enrolled the brand in Amazon's Brand Registry. It alleges that Lssx uses Greatcare's EAN product number, 6937959651264, for its own listing. It alleges, on information and belief, that Lssx registered MOSQUEDA to pass itself off as Greatcare's authorized importer, and it cites a September 2023 Amazon review comparing a second order with a July 2021 order as an example of actual confusion.
Claims and relief requested
Greatcare brings four claims against Lssx: federal trademark infringement under 15 U.S.C. § 1114; false designation of origin and false description under 15 U.S.C. § 1125(a); unfair competition under California Business and Professions Code § 17200 et seq.; and passing off under California Civil Code § 1770(a)(1). The prayer invokes 15 U.S.C. §§ 1116, 1117 and 1118 and asks for a permanent injunction against using Greatcare's marks or product identifiers or suggesting affiliation, removal of listings and materials, delivery for destruction of infringing materials, actual damages, Lssx's profits, enhanced and statutory damages where available, interest, costs and reasonable attorneys' fees where authorized, corrective relief, and other relief.
