The complaint

ThreatLocker, Inc. v. LockThreat, LLC DBA LockThreat, No. 6:26-cv-02547 (M.D. Fla., Orlando Division), is a 26-page complaint filed October 30, 2026, ECF No. 1, with a jury demand. ThreatLocker, a Delaware corporation based in Orlando, Florida, describes itself as a Zero Trust security software company. LockThreat is a Georgia limited liability company based in Alpharetta, Georgia, that the complaint says was founded in or around 2025. The complaint states that it alleges matters other than ThreatLocker's own acts on information and belief unless it says otherwise. (Compl. intro; paras. 1, 2, 8, 18.)

The marks

ThreatLocker pleads four Principal Register registrations for THREATLOCKER: No. 5,589,062, registered October 23, 2018, for software as a service for cybersecurity in Class 42, which it alleges is incontestable; No. 7,388,025, registered May 14, 2024, for cybersecurity webinars and training in Class 41; No. 7,388,029, for a downloadable mobile cybersecurity application in Class 9; and No. 7,512,466, registered September 24, 2024, for endpoint security software as a service and help desk services in Class 42. USPTO TSDR shows No. 7,388,029 registered May 14, 2024 (the complaint's table lists May 24, 2024). TSDR lists ThreatLocker, Inc. as the owner of all four, with a status of registered, and shows a combined Sections 8 and 15 declaration accepted for No. 5,589,062. (Compl. paras. 14 to 16.)

What the complaint alleges

The complaint alleges LockThreat offers a competing security platform for continuous cyber compliance, control monitoring, cyber risk quantification, policy enforcement, and AI threat monitoring to the same industries ThreatLocker serves, and that after acquiring an AI-based security platform in or around June 2026 it folded those services into its LOCKTHREAT-branded platform. It alleges LockThreat filed USPTO applications Serial Nos. 99/352645 for the LOCKTHREAT word mark and 99/355311 for a design mark on August 25, 2025, in Class 42 for cybersecurity software services that ThreatLocker calls identical or closely related to its own. It alleges the marks are closely similar in appearance, sound, and meaning, that the companies market to the same buyers at the same trade shows, and that LockThreat knew of ThreatLocker, pointing to a LinkedIn exchange. It says ThreatLocker sent a demand letter on June 19, 2026, and that LockThreat refused on June 30, 2026, to stop using the marks or abandon its applications. (Compl. paras. 19 to 24, 26, 29 to 34, 38.)

The applications

USPTO TSDR shows both LOCKTHREAT applications, filed August 25, 2025 in Class 42 and owned by LockThreat, LLC, published for opposition on June 2, 2026, with an opposition instituted on September 29, 2026 and pending at the Trademark Trial and Appeal Board. TSDR describes the design mark as a fingerprint within a shield with the word LOCKTHREAT to the right of the design.

Claims and relief requested

The First Claim for Relief alleges federal trademark infringement under 15 U.S.C. § 1114. The Second alleges federal unfair competition and false designation of origin under 15 U.S.C. § 1125(a). The Third alleges violation of the Florida Deceptive and Unfair Trade Practices Act, Fla. Stat. § 501.201 et seq. The Fourth alleges Florida common law unfair competition and trademark infringement. ThreatLocker asks for an injunction against use or registration of the LOCKTHREAT Marks or any confusingly similar mark; transfer of the lockthreat.ai domain and related social media accounts; destruction of materials under 15 U.S.C. § 1118; LockThreat's profits and ThreatLocker's damages, increased, under 15 U.S.C. § 1117(a); punitive damages under Florida common law; and attorneys' fees, costs, and interest. (Compl. paras. 46 to 88; Prayer A to O.)
