What was filed
The complaint is Document 1, filed October 21, 2026, in the U.S. District Court for the Northern District of California. The case is Elevance Health, Inc. v. Elevance Systems, Inc., No. 5:26-cv-12229. It pleads six counts: trademark infringement under 15 U.S.C. § 1114; false designation of origin and unfair competition under 15 U.S.C. § 1125(a); cyberpiracy under the Anticybersquatting Consumer Protection Act, 15 U.S.C. § 1125(d); common law unfair competition; unfair competition under California Business and Professions Code § 17200 et seq.; and false advertising under California Business and Professions Code § 17500. Elevance Health demands a jury trial. Counsel are Austin Padgett and Sean P. McConnell of Troutman Pepper Locke LLP; the complaint says McConnell's pro hac vice application is forthcoming. The complaint runs 17 pages and asks for assignment to the San Jose Division. Its exhibits, A through F, are not freely available on the public docket. The same day, the docket lists a patent and trademark report, two certificates of interested entities, and a proposed summons.
The parties and the marks
The complaint says Elevance Health, Inc. is an Indiana corporation with its principal place of business in Indianapolis, Indiana, that it changed its name from Anthem, Inc. effective June 28, 2022, and that it provides health benefits and insurance coverage to more than 100 million people and offers digital, software, and AI-enabled services. It alleges, on information and belief, that Elevance Systems, Inc. is a Delaware corporation with its principal place of business in Cupertino, California, and, on information and belief, that it was incorporated in January 2024 and markets itself as a healthcare IT managed services company.
Elevance Health asserts five registrations: ELEVANCE HEALTH in standard characters, Nos. 7,158,399 (Classes 9, 35, 38, 41, 42, and 44) and 6,965,805 (Class 36); ELEVANCE HEALTH with a caret design over the letter L, Nos. 7,158,558 (Classes 9, 35, 38, 41, 42, and 44) and 6,965,804 (Class 36); and a stylized E with a caret, No. 7,877,819 (Classes 35, 36, 41, 42, and 44). USPTO records list all five as live and owned by Elevance Health, Inc., an Indiana corporation. Nos. 6,965,804 and 6,965,805 registered on January 24, 2023, Nos. 7,158,399 and 7,158,558 on September 5, 2023, and No. 7,877,819 on August 5, 2025. Each claims first use on June 28, 2022, and the four ELEVANCE HEALTH registrations disclaim HEALTH. The services run from health insurance underwriting and claims administration in Class 36 to health care cost management in Class 35 and online software tools, such as medical cost information and health risk assessment, in Class 42.
What the complaint alleges
According to the complaint, Elevance Systems filed U.S. Application Serial No. 99/762,509 on April 14, 2026, for ELEVANCE SYSTEMS and a design, covering artificial intelligence as a service featuring software for client call assistance, medical transcribing and charting, fax automation, healthcare revenue cycle management, claims efficiency, staffing, and related tasks in Class 42, and claiming first use on May 1, 2025. USPTO records match those details, list Elevance Systems Inc, a Delaware corporation, as the applicant, show SYSTEMS disclaimed, and show the application published for opposition on September 22, 2026. Elevance Health alleges that ELEVANCE is the coined, dominant term in both marks, that the applied-for logo presents ELEVANCE in large dark blue letters with a smaller disclaimed word and a geometric design, as its own marks do, and that the parties offer AI-enabled healthcare technology services to the same healthcare customers through overlapping channels.
For actual confusion, the complaint points to a client testimonial on the defendant's website that refers to Elevance Health rather than Elevance Systems, and the false advertising count relies on the same testimonial. It alleges, on information and belief, that the defendant knew of the ELEVANCE HEALTH name when it adopted its mark and filed the application. On the cyberpiracy count, it alleges that the defendant registered elevancesystems.com, on information and belief on or around November 7, 2023, and uses it with a bad faith intent to profit from the ELEVANCE HEALTH marks.
Relief requested
The prayer asks for findings of liability on each claim; a permanent injunction; removal of the marks from the defendant's advertising, websites, and social media accounts; an order requiring the defendant to expressly abandon Application Serial No. 99/762,509 with prejudice, or alternatively an order under 15 U.S.C. § 1119 directing the USPTO to refuse or cancel it; transfer of elevancesystems.com, or its forfeiture or cancellation, under 15 U.S.C. § 1125(d)(1)(C); destruction of materials under 15 U.S.C. § 1118; an accounting of profits and enhanced damages and attorneys' fees under 15 U.S.C. § 1117(a); damages to fund corrective advertising; statutory damages of up to $100,000 per domain name under 15 U.S.C. § 1117(d), at Elevance Health's election; costs; and interest. The complaint alleges willful infringement.
