What was filed

The complaint is Document 1, filed October 20, 2026, in the U.S. District Court for the Western District of Louisiana, Lafayette Division. The case is Schaeffler Technologies AG & Co., KG v. Gulf Asset Recovery LLC, No. 6:26-cv-04367. It runs 24 pages. Counsel is Madaline King Rabalais and Brian C. Kimball of Butler Snow LLP, with Timothy J. Kelly of T.J. Kelly Intellectual Property Law, P.C. of counsel. Exhibits 1 to 9, which the complaint describes as the registrations with USPTO status printouts, the eBay takedown, correspondence with the seller, eBay listings, photos of a test purchase, and Schaeffler's analysis report, are not freely available on the public docket.

The parties and the marks

The complaint describes Schaeffler as a German company based in Herzogenaurach, Germany, that sells bearings in the United States through U.S. subsidiaries under brands including FAG, INA, and LUK. It says Schaeffler, itself or through predecessors, has used FAG in the United States since at least 1962 and owns, by assignment, FAG Reg. Nos. 759,957 and 3,673,117; that it owns Reg. No. 4,103,952 for the appearance of its FAG packaging; and that it owns X-LIFE Reg. No. 4,899,890 for roller bearings and parts, which it says issued in 2016 and is incontestable. USPTO records show all four registrations live and list Schaeffler Technologies AG & Co. KG as owner of each.

What the complaint alleges

According to the complaint, in July 2024 Schaeffler found a FAG 6220-2RSR.C3 deep groove ball bearing offered on the Gulf Asset Recovery eBay storefront, determined from the listing that it was counterfeit because its markings did not match Schaeffler's marking protocols, and had eBay remove the listing. It says a representative of the seller later asked about the takedown, said the company had three such bearings, and asked Schaeffler to confirm whether they were counterfeit, and that on January 2, 2025, Schaeffler replied that they were and asked that they be sent for destruction, which did not happen. The complaint alleges that in April 2026 the same three bearings were listed again, among four FAG and X-LIFE part numbers totaling eight pieces, that an investigator received a test purchase on April 27, 2026, and that Schaeffler's analysis confirmed it was counterfeit. It alleges, on information and belief, that the seller is still offering the products, says a comparison of its August and September 2026 listings shows that it has apparently sold some of that inventory, and calls the conduct willful.

The six causes of action are infringement of the FAG marks and of the X-LIFE mark under 15 U.S.C. § 1114, unfair competition and false designation of origin under 15 U.S.C. § 1125(a), dilution of the FAG marks under 15 U.S.C. § 1125(c), dilution under La. R.S. § 51:223.1, and violation of the Louisiana Unfair Trade Practices and Consumer Protection Law, La. R.S. § 51:1401 et seq. The prayer asks for preliminary and permanent injunctions, including against using or transferring the defendant's eBay accounts and moving funds in its marketplace and payment accounts; findings of counterfeiting, infringement, dilution, and willfulness; production of documents about the defendant's FAG and X-LIFE products; delivery of products and materials for destruction; damages, attorneys' fees, and costs under 15 U.S.C. § 1117 and Louisiana law; and a freeze of the defendant's bank, marketplace, and other assets until any award is paid.
