Foodees LLC, No. 2:26-cv-12107, and it includes a jury demand. It pleads four counts: federal trademark infringement under 15 U.S.C. § 1114; false designation of origin and unfair competition under 15 U.S.C. § 1125(a); common law trademark infringement and unfair competition; and unlawful, unfair, and fraudulent business practices under Cal. Bus. & Prof. Code § 17200 et seq. Counsel are Daniel C. Posner, Mikayla Wasiri, and Todd Anten (pro hac vice forthcoming) of Quinn Emanuel Urquhart & Sullivan, LLP. The complaint runs 27 pages.

The parties and the marks

FoodieLand LLC is a California limited liability company based in Monrovia, California. The complaint says it has staged ticketed FOODIELAND food and beverage festivals and night markets since a 2019 event in Berkeley, California, with venues including the Rose Bowl Stadium in Pasadena, the Del Mar Fairgrounds, and the Cow Palace in Daly City, and a touring schedule across eight states. It says general admission is commonly about $12. Foodees LLC is alleged, on information and belief, to be a North Carolina limited liability company formed on or about February 23, 2023, that operates festivals under the name FoodeesFest at foodeesfest.com.

The complaint lists three registrations owned by FoodieLand: Reg. No. 7,922,572 for FOODIELAND (August 26, 2025), and Reg. Nos. 6,760,903 (June 14, 2022) and 6,038,376 (April 21, 2020) for FOODIELAND NIGHT MARKET. USPTO records list Foodieland LLC as the owner of all three. It also identifies pending Serial No. 99/770,693, filed April 17, 2026, and published September 22, 2026, claiming first use on February 28, 2019, and claims common law rights in FOODIELAND and FOODIELAND NIGHT MARKET word and design marks. It alleges, on information and belief, that Foodees LLC owns no federal registrations or pending applications.

What the complaint alleges

FoodieLand alleges, on information and belief, that Foodees LLC ran regional food-truck events in the Carolinas and Georgia as the "Foodees Food and Culture Festival," and that around late 2025 or early 2026 it began using FOODEESFEST. It also alleges that Foodees LLC moved to a tent-vendor format with food, artisan, and retail vendors, and expanded into Texas. It alleges the FOODEESFEST word mark and a two-tone sans-serif logo with FOODEES in bold are confusingly similar to the FOODIELAND marks.

The complaint also alleges that after FoodieLand launched its current website on October 13, 2025, Foodees LLC rebuilt its own site between January and March 2026 to adopt FoodieLand's navigation structure, event card format, FAQ design, and footer page URLs, and copied text from FoodieLand's "Join Us" page nearly word for word. It pleads this as evidence of intent.

On scheduling, the complaint alleges that FoodieLand announced its September 18 to 20, 2026, Charlotte Motor Speedway dates on December 12, 2025, and that Foodees LLC posted a new schedule on December 23, 2025, adding a Charlotte FOODEESFEST event, which it held September 11 to 13, 2026. As actual confusion, it alleges that at least one attendee presented FOODEESFEST tickets at FoodieLand's Charlotte box office, and it quotes TikTok comments mixing up the two festivals.

Relief requested

Count IV separately says FoodieLand is entitled to any restitution available under California law. The complaint states no damages figure.
