What the complaint alleges

The complaint says LA Enterprises Holding LLC is a Delaware limited liability company with a business address at 501 Silverside Road, Suite 87, Wilmington, Delaware 19809. It says the company holds trademarks and uses them through franchising, licensing, and affiliated operating ventures. It says LA Enterprises owns U.S. Registration No. 5,771,736 for HONEY BERRY PANCAKES AND CAKE (& design), for restaurant and cafe services, with use as early as April 15, 2019. It says 13 restaurants and cafes operate under the mark in Illinois, Wisconsin, and Texas, and it points to honeyberrycafe.com. It lists eight Illinois locations: Aurora, Bolingbrook, Chicago, Hoffman Estates, Lansing, Lombard, North Aurora, and Rolling Meadows.

The complaint says Honey Berry LLC is a New Jersey limited liability company with a principal business address at 1321 3rd Ave, Spring Lake, New Jersey 07762, operating a Honey Berry Cafe, with further information at honeyberrynj.com. It lists George Melassanos as a manager of Honey Berry LLC and as its registered agent.

The complaint alleges that a customer asked whether LA Enterprises was related to the New Jersey cafe. It alleges that the marks share the dominant words HONEY BERRY and a similar stylization, and that the cafe services are identical. It says a letter was signed for on July 14, 2026, that Honey Berry LLC responded through counsel on July 20, 2026, that the plaintiff replied and then heard nothing, and that an August 31, 2026 follow-up received no response. Count I alleges infringement under 15 U.S.C. § 1114. Count II alleges unfair competition and false designation of origin under § 1125(a). The complaint also pleads Illinois claims under 815 ILCS 505, 765 ILCS 1036, and 815 ILCS 510. The prayer seeks a permanent injunction, profits, and damages. A court has not granted any of that.
