What was filed
The case is Marc O'Keefe v. Michael O'Keefe, Perfect Edge Holdings, LLC, Perfect Edge Howell, LLC, and Perfect Edge Novi, LLC, each d/b/a "The Original Perfect Edge", No. 2:26-cv-14233 (E.D. Mich., Southern Division), filed November 5, 2026, ECF No. 1, with a jury demand. The complaint says Marc O'Keefe is an individual in Traverse City, Michigan, and alleges, on information and belief, that Michael O'Keefe lives in Brighton, Michigan, and operates retail hockey stores in Novi and Howell, Michigan. It says Perfect Edge Holdings, LLC was organized on June 23, 2026, and Perfect Edge Howell, LLC and Perfect Edge Novi, LLC on July 20, 2026, all as Michigan limited liability companies. It says the two men are brothers who operated the Perfect Edge business together.
The marks
USPTO TSDR lists Marc O'Keefe, an individual, as owner of three registrations on the Principal Register, each registered May 19, 2026, and each shown as registered: PERFECT EDGE HOCKEY in standard characters, U.S. Reg. No. 8,263,572, and PERFECT EDGE HOCKEY - LACROSSE in standard characters, U.S. Reg. No. 8,263,599, both for online retail and retail store services featuring sporting goods in Class 35; and PERFECT EDGE HOCKEY - LACROSSE in an oval design with two crossed hockey sticks and a ball on one side and two crossed lacrosse sticks and a ball on the other, U.S. Reg. No. 8,261,715, for online retail and retail store services featuring hockey and lacrosse sporting goods in Class 35. The complaint calls the design mark the PEH Logo and alleges the marks have been used since at least June 1, 2005.
What the complaint alleges
The complaint alleges that on June 18, 2026, after mediation, the brothers signed a Binding Settlement Term Sheet separating their business interests, under which Michael O'Keefe agreed that Marc O'Keefe "will own and exclusively use the company logos," and that any license to Michael O'Keefe covers only the name Perfect Edge Hockey and/or Lacrosse. It says the term sheet is a confidential mediation document that the plaintiff will file under seal by separate motion. It alleges that since at least August 1, 2026, the defendants have used the PEH Logo without consent, and that they use the name "The Original Perfect Edge" on store signage, social media, websites, and an online storefront.
The complaint alleges that the defendants told the market the business had changed its name, including an August 4, 2026 Facebook graphic announcing "NEW NAME. SAME GREAT SERVICE." and posts, which it alleges on information and belief the defendants authored, supplied, or approved, stating that "Perfect Edge Hockey is now… The Original Perfect Edge." It alleges that the defendants' profiles and website claim the business has served the hockey community since 1999 or been in business since 2005, that Michael O'Keefe told customers who wrote to the legacy business email that it was "not a working email anymore," and it alleges actual confusion, citing third-party sponsorship posts, customer comments, and a youth hockey program's jersey inquiry to the legacy email that the defendants answered with a quote. It also says the brothers are in a pending arbitration under the term sheet, and asks that, if any claim falls within the arbitration clause, the court grant provisional injunctive relief in aid of arbitration and stay only that claim under 9 U.S.C. § 3.
The claims and relief requested
The complaint pleads six counts: infringement of registered marks under 15 U.S.C. § 1114(1), false designation of origin and unfair competition under 15 U.S.C. § 1125(a)(1)(A), and false advertising under 15 U.S.C. § 1125(a)(1)(B), each against all defendants; common-law trademark infringement and unfair competition under Michigan law against all defendants; breach of contract against Michael O'Keefe; and a declaratory judgment under 28 U.S.C. § 2201 against all defendants on ownership of the marks and the scope of the term sheet license. It asks for preliminary and permanent injunctions, transfer or deactivation of accounts, listings, and domain names using "The Original Perfect Edge," destruction of materials under 15 U.S.C. § 1118, a sworn compliance report under 15 U.S.C. § 1116(a), corrective notices, an accounting and disgorgement for diverted inquiries, profits, damages enhanced up to three times, costs, an exceptional-case finding, and attorney fees under 15 U.S.C. § 1117(a), contract and exemplary damages under Michigan law, the requested declarations, and interest.
