What the complaint alleges

The complaint alleges, on information and belief, that AB BUSINESS PRO INC operates a retail convenience store in Hialeah, Florida, and has advertised, displayed, offered for sale, and sold products bearing counterfeit reproductions of the LION AND LIONESS and NEW EXTREME marks. It says that on or about May 21, 2026, as part of an ongoing investigation, an investigator for the plaintiffs bought the accused goods at the store, and that a comparison with genuine products shows differences, including yellow and red capsule casings instead of orange and yellow ones and white powder inside the capsules instead of the proprietary color used in genuine products. It alleges that Amethyst Enterprise sent the defendant a demand letter on or around June 18, 2026, that the defendant has not responded meaningfully, provided supplier or source information, or taken remedial action, and, on information and belief, that it continues to sell the accused goods, and it alleges that the defendant's use involves counterfeit marks as defined in 15 U.S.C. § 1116(d)(1)(B).
