Federation of the Swiss Watch Industry FH v. anjiroad.com a/k/a caroline-superwatch.com a/k/a devonten.com a/k/a jessicabing.com a/k/a philip-luxury.com, No. 1:25-cv-26169 (S.D. Fla.), was filed December 31, 2025. The defendant is captioned as an individual, business entity, or unincorporated association operating under those five e-commerce store names, and the complaint alleges, on information and belief, that it resides or operates in a foreign jurisdiction. The complaint seeks damages and injunctive relief for federal trademark counterfeiting and infringement, false designation of origin, and Florida common law unfair competition and trademark infringement. (Compl. caption; paras. 1, 9.)

The marks

The complaint alleges the Federation owns two certification marks registered on the Principal Register for horological and chronometric instruments, namely watches, clocks, and their component parts and fittings: SWISS MADE, Registration No. 3,038,819 (January 10, 2006), and SWISS, Registration No. 3,047,277 (January 24, 2006). It alleges the marks certify watches made in Switzerland under standards the Federation sets according to Swiss law, that members and qualifying non-members may use them, and that the defendant was never licensed. USPTO records list both registrations as live certification marks owned by the Federation of the Swiss Watch Industry, each with a renewal status dated December 12, 2025. (Compl. paras. 16 to 19.)

What the complaint alleges

The complaint alleges the defendant promoted, sold, offered for sale, or distributed goods using counterfeits and confusingly similar imitations of the SWISS MADE and SWISS marks through internet e-commerce stores under the five store names, directed sales to consumers in Florida, and used the store names and related payment accounts to carry out the scheme. Count I alleges trademark counterfeiting and infringement under 15 U.S.C. 1114. Count II alleges false designation of origin under 15 U.S.C. 1125(a). Count III alleges common law unfair competition, and Count IV alleges common law trademark infringement. (Compl. paras. 2, 9 to 15; Counts I to IV.)
