Fla., Miami Division), entered on the docket September 17, 2026. It runs 33 pages and demands a jury trial. The clerk's notice assigns the case to Judge K. The marks
The complaint relies on Reg. No. 7,212,008 for DRUNK SHAKESPEARE in standard characters, registered November 7, 2023 for theatre productions in Class 41, and Reg. Nos. 7,633,184 and 7,633,186 for DRUNK in standard characters and in stylized form, registered December 31, 2024 for theatrical entertainment services. It also asserts trade dress. USPTO TSDR lists all three registrations as owned by Brass Jar, Inc.
What the complaint alleges
The complaint says Brass Jar produces Drunk Shakespeare, which combines Shakespearean performance with drinking, in several U.S. cities. It alleges, on information and belief, that Off Campus debuted on Amazon's streaming service in May 2026, and it alleges that Episode Four, "The Breakup," shows characters attending a fictional amateur college theatrical event they call Drunk Shakespeare, in which performers and audience members drink during a student performance of A Midsummer Night's Dream. It alleges that this use works as a trademark within the series and as an identifier of source, that the name also appears in closed captioning and marketing, and that viewers have expressed confusion on social media about the relationship between the series and Brass Jar's productions.
Claims and relief
The eight counts are infringement under 15 U.S.C. § 1114(1), false designation of origin and unfair competition under 15 U.S.C. § 1125(a), trade dress infringement under 15 U.S.C. § 1125(a), Florida common law trademark infringement and unfair competition, trademark counterfeiting under 15 U.S.C. §§ 1114, 1116, and 1117, the Florida Deceptive and Unfair Trade Practices Act, unjust enrichment, and common law trademark infringement.
On the docket
On October 15, 2026, Brass Jar filed waivers of service for Amazon.com, Inc. and Amazon Technologies, Inc., and an amended complaint that the docket lists as against those two defendants.
