What was filed

The complaint is Document 1 in Vetr, LLC v. Vetr Health LLC, Vetr Health, Inc., and Vetr Health Veterinary Service of Michigan, P.C., No. 1:26-cv-02611 (W.D. Mich., Southern Division), filed September 17, 2026. It is a 23-page verified complaint and demands a jury trial. The docket shows the case assigned to Judge Paul L. Maloney.

The marks

The complaint alleges that Vetr, through a predecessor, has used VETR for veterinary pharmaceuticals and related services since at least 2018, and in Michigan since at least 2020, and has run Amazon, Walmart, and eBay storefronts under VETR LABS since at least September 17, 2024. It says Vetr filed applications to register VETR on May 17, 2024, Serial Nos. 98/557,355 (Class 35) and 98/557,357 (Class 44), and on November 18, 2024, Serial No. 98/859,907 (Class 5). It says Vetr Health LLC filed applications for VETR HEALTH and a VETR HEALTH logo on July 18, 2023, Serial Nos. 98/090,043 and 98/090,084, and that Vetr opposed both at the Trademark Trial and Appeal Board, Opposition Nos. 91296146 and 91297151, on the ground that they are void for non-use. USPTO TSDR lists Vetr's three applications as suspended and the two Vetr Health LLC applications as subject to a pending opposition.

What the complaint alleges

The complaint alleges that the defendants, years after Vetr's first use, adopted VETR, VETR AI, VETR HEALTH, VETR LABS, and a VETR HEALTH logo. On information and belief, it alleges that they run a veterinary services business based in Grand Rapids, Michigan, that they recently expanded their use of those names, including into online retail veterinary pharmacy services, and that they share common ownership and management.

Claims and relief

The four counts are federal unfair competition, false designation of origin, and infringement of unregistered marks under 15 U.S.C. § 1125(a); Michigan common law trademark infringement; Michigan common law unfair competition; and violation of the Michigan Consumer Protection Act. Among other relief, the complaint asks for an order instructing the defendants to abandon Serial Nos. 98/090,043 and 98/090,084. The docket shows summons issued to all three defendants on September 24, 2026.
