The order

The preliminary injunction order is Document 30 in BlushCrunch Studio LLC v. The Individuals, Corporations, Limited Liability Companies, Partnerships, and Unincorporated Associations Identified on Schedule A to the Complaint, No. 1:26-cv-07871-PAE (S.D.N.Y.), dated October 20, 2026 and signed by Judge Paul A. Engelmayer. Schedule A lists 95 defendant stores, most of them Shein storefronts, with others on eBay and Walmart.

The rights

The order covers U.S. Trademark Registration No. 8,218,195, which it calls the BLUSHCRUNCH Trademark, and 37 U.S. Copyright Office registrations in the VAu series, together called the BLUSHCRUNCH Intellectual Property. USPTO records show Registration No. 8,218,195 is for the stylized mark DANDY'S WORLD, registered April 21, 2026 to BlushCrunch Studio LLC for action figures, toy figurines, and stuffed and plush toys in Class 28.

Findings

The court found personal jurisdiction because the defendants run interactive online stores through which New York residents can buy and receive the accused products. On the plaintiff's declarations, it found a prima facie case of trademark infringement and counterfeiting and copyright infringement, irreparable harm through lost goodwill, exclusivity, and future sales, no adequate remedy at law, and that the public interest favors relief. It held that the relief first granted in the October 6, 2026 TRO should remain in place. These are preliminary findings on a likelihood of success; the infringement and counterfeiting claims in the complaint remain allegations until decided on the merits.

What it orders

The defendants are enjoined from using the BLUSHCRUNCH Intellectual Property or imitations with the accused products, from passing off, and from moving inventory. Each must serve a sworn report on its identity, accounts, and compliance within fourteen days. Within five days, eBay, Shein, Walmart, and other platforms with notice must disable the defendants' accounts, and third party providers, including listed payment processors, must provide expedited discovery within five business days. The defendants' assets are frozen. Notice by electronic publication and email is authorized, defendants may move to dissolve or modify on two days' notice, and the $5,000 bond remains with the court.
