What was filed

Eli Lilly and Company v. MedShape Weight Loss Clinic, LLC, No. 2:26-cv-07361-SPL (D. Ariz.), was filed October 8, 2026, the same day as Lilly's Northern District of Texas complaint, No. 4:26-cv-01294. The complaint says MedShape is an Arizona limited liability company based in Scottsdale. A docket entry that day assigned the case to Judge Steven P. Logan. Lilly demands a jury trial.

What the complaint alleges

As in the Texas suit, Lilly alleges that no retatrutide medicine is FDA-approved and that MedShape sells products it says contain retatrutide that cannot lawfully be sold. It alleges that MedShape tells consumers phase 3 trials show 24 to 30 percent weight loss in as little as 48 weeks, set against figures for semaglutide and tirzepatide, and that these comparisons are false because no head-to-head trials have compared MedShape's products with any FDA-approved medicine. It also alleges that adverse events from unapproved retatrutide products harm the reputation of retatrutide itself.

The count and relief

The first and only cause of action is false or misleading advertising under 15 U.S.C. § 1125(a)(1)(B). Lilly asks for a declaration, a permanent injunction, corrective advertising disclosing that retatrutide is investigational and not FDA-approved, a compliance report, MedShape's profits and damages, interest, and fees under 15 U.S.C. § 1117. The docket shows service executed on October 15, 2026.
