What was filed
Eli Lilly and Company v. Southlake Mhya PLLC d/b/a Medrein Health & Aesthetics, No. 4:26-cv-01294-P (N.D. Tex., Fort Worth Division), was filed October 8, 2026. The complaint describes Medrein as a med spa in Southlake, Texas. A docket entry the same day reassigned the case to Judge Mark Pittman after a recusal. Lilly demands a jury trial. Lilly filed a parallel complaint the same day in the District of Arizona, No. 2:26-cv-07361.
What the complaint alleges
The complaint alleges that neither FDA nor any other regulator has approved a medicine containing retatrutide, and that no retatrutide product may lawfully be sold to consumers. It alleges that Medrein markets purported retatrutide products on its website and social media, points consumers to Lilly's clinical trial data without saying those data do not cover Medrein's products, and claims its products give better results than the active ingredients in FDA-approved medicines, including Lilly's MOUNJARO and ZEPBOUND. It alleges those comparative claims are false because no head-to-head trials have compared Medrein's products with any FDA-approved medicine.
The count and relief
The single cause of action is false or misleading advertising under 15 U.S.C. § 1125(a)(1)(B). Lilly asks for a declaration, a permanent injunction against marketing any product containing or said to contain retatrutide and against comparative claims and use of Lilly's trial data, corrective advertising, a compliance report, Medrein's profits, damages, interest, and fees under 15 U.S.C. § 1117.
