What was filed
John 8 Verse 7 Ventures, LLC v. Precision Health Technologies, LLC, No. 2:26-cv-00323-RWS (N.D. Ga., Gainesville Division), was filed October 1, 2026. The plaintiff says it is a Georgia limited liability company and the real party in interest for a registration that the USPTO record lists under the name John 7 Verse 7 Ventures LLC, which it calls a scrivener's error. It identifies Precision Health as a Minnesota limited liability company. The plaintiff demands a jury trial.
The registration and the Board decision
USPTO records show Reg. No. 7,434,855 for RE-GAIN RX registered July 2, 2024, for nutritional supplements in Class 5, and show it cancelled under Section 18 by the Board on July 30, 2026. The complaint alleges that Precision Health applied in April 2024 to register GI-REGAIN for digestive-health supplements for livestock and poultry and that the USPTO refused that application under Section 2(d) based on RE-GAIN RX. It alleges that Precision Health petitioned to cancel the registration on August 29, 2025, that the Board granted Precision Health's motion to compel as conceded in May 2026, and that on July 30, 2026, the Board granted its unopposed motion for discovery sanctions, entered judgment, and directed cancellation. The complaint says the Board did not decide the pleaded cancellation grounds on the merits, and the plaintiff says it will present additional evidence in the district court.
The counts and relief
Count One is the civil action for review under 15 U.S.C. § 1071(b). Count Two alleges infringement of the registration under 15 U.S.C. § 1114, and Count Three alleges false designation of origin under 15 U.S.C. § 1125(a), both over continued use of GI-REGAIN. The prayer asks the court to reverse, vacate, or modify the Board's judgment and restore the registration, declare the plaintiff's rights in RE-GAIN RX, enjoin use of GI-REGAIN, and award profits, damages, costs, and fees if the case is found exceptional.
