What was filed

Fairview Health Services v. United Healthcare Services, Inc. and UnitedHealthcare Insurance Company, No. 0:26-cv-04245-KMM-ECW (D. Minn.), was filed October 1, 2026. Fairview says it is a Minneapolis-based nonprofit health system. It identifies United Healthcare Services, Inc. as a Minnesota corporation and UnitedHealthcare Insurance Company as a Connecticut corporation. The clerk's assignment notice assigns the case to Judge Katherine M. Menendez. Fairview demands a jury trial.

What the complaint alleges

The complaint alleges that Fairview declined in June 2026 to renew its contract with UnitedHealthcare Medicare Advantage plans effective January 1, 2027, but that the defendants and their affiliates have represented to patients that Fairview remains in network for 2027 plans. It alleges that seniors choosing plans during the annual enrollment period that began October 15, 2026 may enroll in plans that will not cover Fairview care in 2027, and that Fairview faces lost patients, reputational harm, and the cost of contacting patients to correct the confusion.

The counts and relief

Count I is false advertising under 15 U.S.C. § 1125(a). Count II arises under the Minnesota Uniform Deceptive Trade Practices Act, Minn. Stat. §§ 325D.43 to .48, and Count III is tortious interference with prospective economic advantage under Minnesota common law. The prayer asks for a temporary restraining order before enrollment opened on October 15, 2026, a permanent injunction against misstatements of Fairview's network status for plan years beginning January 1, 2027, disgorgement of profits from Fairview patients who enroll in 2027 plans, compensatory damages, and fees.

On the docket

Fairview moved for a preliminary injunction on October 2, 2026. On October 9, after the parties told the court they were continuing to work toward a resolution of the issues underlying that motion, the court cancelled the hearing and vacated the briefing schedule. The docket shows status conferences before Judge Menendez on October 7 and October 15 and an October 22 order on a motion to extend the time to answer.
