What was filed

Superhuman Platform Inc. v. 1mind AI, Inc., No. 3:26-cv-11711 (N.D. Cal.), was filed October 9, 2026. Superhuman says it is a Delaware corporation based in San Francisco, and it alleges, on information and belief, that 1mind is also a Delaware corporation based in San Francisco. Superhuman demands a jury trial.

The marks

The complaint alleges that Superhuman has used SUPERHUMAN continuously since at least January 2017. It relies on U.S. Reg. No. 5,675,657 for SUPERHUMAN, which USPTO records show registered February 12, 2019, to Superhuman Platform Inc. in Classes 35, 38, and 41, with a combined Sections 8 and 15 declaration accepted; the Class 35 services include customer relationship management. The complaint says that registration is incontestable. It also pleads Reg. No. 3,941,705 for SUPERHUMAN PLATFORM and two pending Superhuman applications, one of them for SUPERHUMAN GO.

What the complaint alleges

The complaint alleges that around June 2025, 1mind announced a Superhuman-branded AI platform aimed at enterprise sales, marketing, and customer success, that 1mind markets it to Superhuman's customers, and that 1mind's website chatbot, also called Superhuman, describes features that track Superhuman's own. It alleges that Superhuman raised its rights with 1mind in June 2025, that 1mind filed a second, broader SUPERHUMAN application in July 2025, and that in December 2025 Superhuman opposed 1mind's first application, Serial No. 98880288, at the Trademark Trial and Appeal Board.

The counts and relief

The first cause of action is infringement of a registered mark under 15 U.S.C. § 1114. The second is false designation of origin under 15 U.S.C. § 1125(a)(1)(A). The third and fourth arise under California Business and Professions Code §§ 17200 and 17500, and the fifth is common law trademark infringement and unfair competition. The prayer asks for preliminary and permanent injunctions, an order under 15 U.S.C. § 1119 directing the USPTO to refuse Serial Nos. 98880288 and 99303350, damages and profits, enhanced and exemplary damages, restitution, an accounting, corrective notices, and fees. The docket shows the summons returned executed on October 19, 2026.
