What was filed

The complaint is Document 1, filed October 14, 2026, in the U.S. District Court for the Southern District of California. The case is Patrick Ta Beauty, LLC v. CVS Pharmacy, Inc. and Akstrom Imports, Inc., No. 3:26-cv-05867, and it includes a jury demand. It pleads three counts: trademark infringement and unfair competition under the Lanham Act, 15 U.S.C. §§ 1114 and 1125; common-law trademark infringement; and unfair competition under California Business and Professions Code § 17200 and the common law. Counsel are Matthew L. Seror and Neusha Etemad of Buchalter LLP.

What the complaint alleges

Patrick Ta Beauty says it has made and sold cosmetics since at least 2018 and owns U.S. Reg. No. 6,653,954 for PATRICK TA (compacts containing make-up, cosmetics, make-up, and make-up sets in Class 3) and U.S. Reg. No. 6,202,397 for MAJOR HEADLINES (compacts containing make-up, cosmetics, and make-up in Class 3). It also claims common-law rights in OH SHES SINGLE, SHES NOT FROM HERE, FULL SYRINGE, NEED HER, TWO CCS, and MAJOR VOLUME. It says it controls authorized sales channels and that goods sold through those channels carry its warranty and return terms.

It alleges that in or about September 2026 it learned CVS was marketing and selling unauthorized products bearing the PTB Marks in its stores, including at least one store in the Southern District of California, and that CVS acquired those products from Akstrom. It says the goods are materially different from authorized goods because CVS buyers do not receive the same warranty and customer-service terms, that Akstrom supplied point-of-sale materials using the marks, and that neither defendant was authorized to sell the products or use the marks that way. It says it sent a demand on or about September 24, 2026, and that defendants did not meaningfully respond. The prayer asks for preliminary and permanent injunctive relief, delivery up or destruction of marked goods and materials under 15 U.S.C. § 1118, damages including profits and trebling under 15 U.S.C. § 1117, attorneys' fees, and other relief.
