The complaint says SharkNinja Operating LLC is a Delaware limited liability company with its principal place of business in Needham, Massachusetts, and that it designs, manufactures, and sells household and cleaning products under the Shark and Ninja names. It alleges, on information and belief, that Spray and Pray LLC is a Wyoming limited liability company, also known as Omega Distributions Co and 13007332 Canada Inc., with a principal place of business at 30 N Gould St, Ste R, Sheridan, Wyoming 82801, selling on Amazon.com under seller ID AT49NB6OPEIMC.
The complaint lists these registrations among the SharkNinja marks: SHARK, Registration No. 4,329,299 (April 30, 2013); SHARK, Registration No. 2,771,850 (October 7, 2003); SHARK IQ ROBOT, Registration No. 6,131,311 (August 18, 2020); and NINJA, Registration No. 5,453,690 (April 24, 2018).
The complaint alleges that Spray and Pray advertises one SharkNinja product and then fulfills the order with a different one. It describes a test buy in which SharkNinja ordered model NC601 and alleges that Spray and Pray shipped model CN601CO instead. It alleges that Spray and Pray falsely advertises products as "new" and as covered by SharkNinja warranties, when the products are used and are not protected by those warranties. It alleges a further scheme: Spray and Pray buys SharkNinja products through direct-to-consumer channels and TikTok Shop, obtains refunds by representing that the products are being returned, does not return them, and resells them on Amazon. The complaint alleges, on information and belief, that the inventory exceeds 600 units of new product launches and that the scheme has let Spray and Pray obtain the Amazon "Buy Box" on multiple listings. It also alleges, on information and belief, that Spray and Pray is selling stolen SharkNinja products.
Count I is headed unfair competition and false advertising under 15 U.S.C. § 1125(a). The complaint also calls that count federal trademark infringement under § 1125(a). The other counts allege common-law conversion, common-law fraud, and unfair competition under Massachusetts General Laws chapter 93A. The prayer seeks injunctive relief under § 1116 and damages, profits, and fees under § 1117, along with the state-law relief. A court has not granted any of that.
