What was filed

The docket lists a complaint for in rem relief, captioned a Verified Complaint for In Rem Relief, filed on September 24, 2026, in the U.S. District Court for the Eastern District of Virginia (Alexandria Division). The case is Virginia Department of Health v. virginiawic.com, No. 1:26-cv-03167. Document 1 is that complaint. The same day, VDH filed an emergency motion for a temporary restraining order and noticed it for hearing on October 16, 2026. The docket does not show a ruling on that motion or a judgment.

What the complaint alleges

The complaint is an Anticybersquatting Consumer Protection Act action under 15 U.S.C. § 1125(d). It alleges that VDH long used the VIRGINIA WIC mark for Virginia's Special Supplemental Nutrition Program for Women, Infants, and Children, and that from February 2018 until early 2026 VDH owned virginiawic.com and used it to point the public to official WIC resources. The complaint does not claim a federal registration for VIRGINIA WIC. It alleges that the mark is protected under Section 43(a) of the Lanham Act.

It alleges that after an employee departure, VDH's domain registration inadvertently lapsed, and that on June 2, 2026 an unknown third party, using a privacy service, registered the domain. It alleges the registrant redirects people seeking Virginia WIC information to commercial adult websites and, on information and belief, is compensated for that traffic. Count I is cybersquatting under § 1125(d). The prayer asks the court to order transfer of the domain to VDH.

A complaint is not a ruling

None of this is a finding. A newly filed complaint and TRO papers tell you what VDH alleges and asks for. They do not tell you that the registrant cybersquatted or that the domain will be transferred. The court has not decided the case.
